Our mission is to provide people with the best way to experience the world’s tropical and subtropical regions, and to play a part in helping to ensure the regions and wildlife are around for future generations.

This is achieved by offering tours, lodges, and cruises from the world’s highest rated operators who operate in a manner respectful to the local communities, the biodiversity, and the area they work in.

To achieve this goal, we will live up to the following practices:

• We provide tours from high-rated operators to make sure you are looked after on your experience, so you can focus on the incredible regions you are visiting.
• Although you have direct contact with tour operators, we are here to offer tour advice and to help you choose the best experience based on our extensive research and our own experiences of the regions featured.
• We are continually researching, experiencing, evaluating, and adding new tours, lodges and cruises to make sure our featured experiences are up to date.
• None of the experiences listed have any mark-up from the tour operator’s base rate. 

Definitions

‘TourTheTropics.com’, ‘we’, ‘us’, ‘Platform’, ‘Website’ refers to TourTheTropics.com

‘Tour Operator’, ‘operator’, ‘provider’ refers to the company organizing the experience, arranging the tour and travel services, hiring the guides, managing the operation of the tour, the lodge or hotel owners or operators, the cruise vessel owners, or company leasing the cruise vessel.

"Tour Service" means the online reservation service as offered or enabled by TourTheTropics.com in respect of various products and services as from time to time made available by Tour Operators on the Platform, including, but not limited to, hotel package tours, cruises, and other tours, treks and expeditions.

"Tour Reservation" means the order, purchase, payment, booking, or reservation of a Tour.

Scope & Nature of Our Service

Through the Platform, TourTheTropics.com provides an online platform through which Tour Operators can advertise, market, sell, promote and/or offer (as applicable) their products and services for reservation and through which relevant visitors of the Platform can discover, search, compare, and make a reservation. By using the Tour Service and making payment with the Tour Operator, you enter into a direct (legally binding) contractual relationship with the Tour Operator with which you make a reservation or purchase a product or service (as applicable).

From the point at which you make contact with the Tour Operator, we act solely as an intermediary between you and the Tour Operator, transmitting the relevant details of your reservation to the relevant Tour Operator(s) and sending you communication on behalf of the Tour Operator. TourTheTropics.com does not (re)sell, rent out, offer any (travel) product or service.

When rendering our Tour Service, the information that we disclose is based on the information provided by Tour Operators.

Although we will use reasonable skill and care in performing our Tour Service, we will not verify and cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade, or maintenance of our Platform or otherwise), inaccurate, misleading, or untrue information, nor non-delivery of information.

As such, you and the Tour Operator are responsible for communicating and understanding  the accurate information regarding the Tour Service (including the rates/fees/prices, policies, conditions, availability, and other relevant information) before you enter into the contractual relationship with the Tour Operator.

Our Tour Service is made available for personal and non-commercial use only. Therefore, you are not allowed to resell, deep link, use, copy, monitor (e.g. spider, scrape), display, download, or reproduce any content or information, reservations, products, or services available on our Platform for any commercial or competitive activity or purpose.

Free for consumers

Unless indicated otherwise, our service is free of charge for consumers. Unlike other providers, we will not charge you for our Tour Service or add a markup or any additional (reservation) fees to the rate. You will pay the Tour Operator the relevant amount as indicated by the Tour Operator as advertised (plus—insofar not included in the price—relevant applicable taxes, levies, and fees (if applicable)).

Tour Operators pay a commission (being a small percentage of the tour price) to TourTheTropics.com after the end user has consummated the service or product of the Tour Operator (e.g. after the guest has been on (and paid for) the tour).

Tour Operators can improve their visibility across the site by increasing their commission if the Tour Service is in alignment with our mission. This is at each Tour Operator's discretion and may be used from time to time and product to product offered.

Only Tour Operators which have a commercial relationship with TourTheTropics.com (through an agreement) can be contacted and reserved via the Platform (for their B2B and/or B2C promotion of their product). TourTheTropics.com is not an open platform (like Amazon or eBay) where end users can make their product available (no C2C platform); TourTheTropics.com does not allow non-professional or unreviewed parties to offer or sell their products on or through TourTheTropics.com.

(Further) Correspondence and Communication

By sending a request using TourTheTropics.com, you agree to receive (i) follow-up emails to check you have received the information and are interested in the Tour Service, (ii) an email after arrival to rate the (experience with your) Tour Operator and the Tour Service, (iii) an email inviting you to join our monthly newsletter featuring other tours of interest, (vi) and an email which we may send to you promptly after your tour inviting you to complete our guest review form. TourTheTropics.com disclaims any liability or responsibility for any communication by or with the Tour Operator on or through its platform. You cannot derive any rights from any request to, or communication with, the Tour Operator or (any form of) acknowledgement of receipt of any communication or request. TourTheTropics.com cannot guarantee that any request or communication will be (duly and timely) received/read by, complied with, executed, or accepted by the Tour Operator.

In order to duly complete and secure your reservation, you need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address, or inaccurate or wrong (mobile) phone number or credit card number.

Disclaimer

To the extent permitted by law, neither we nor any of our distributors, agents, or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents will be liable for (i) any punitive, special, indirect, or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability, and ratings) of the Tour Operator as made available on our Platform, (iii) the services rendered or the products offered by the Tour Operator or other business partners, (iv) any (direct, indirect, consequential, or punitive) damages, losses, or costs suffered, incurred, or paid by you, pursuant to, arising out of or in connection with the use, inability to use, or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential, or punitive) damages, losses, or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Tour Operator or any of our other business partners (including any of their employees, directors, officers, agents, representatives, subcontractors, or affiliated companies) whose products or service are (directly or indirectly) made available, offered, or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure, or any other event beyond our control.

TourTheTropics.com is not responsible (and disclaims any liability) for the use, validity, quality, suitability, fitness, and due disclosure of the Tour and makes no representations, warranties, or conditions of any kind in this respect, whether implied, statutory or otherwise, including any implied warranties of merchantability, title, non-infringement, or fitness for a particular purpose. You acknowledge and agree that the relevant Tour Operator  is solely responsible and assumes all responsibility and liability in respect of the Tour (including any warranties and representations made by the Tour Operator). TourTheTropics.com is not a (re)seller of the Tour. Complaints or claims in respect of the Tour (including related to the offered (special/promotion) price, policy or specific requests made by Customers) are to be dealt with by the Tour Operator. TourTheTropics.com  is not responsible for and disclaims any liability in respect of such complaints, claims, and (product) liabilities.

Whether or not the Tour Operator has charged you for your Tour, or if we are facilitating the payment of the (Tour) price or fee, you agree and acknowledge that the Tour Operator is at all times responsible for the collection, withholding, remittance, and payment of the applicable taxes due on the total amount of the (Tour) price or fee to the relevant tax authorities. TourTheTropics.com is not liable or responsible for the remittance, collection, withholding, or payment of the relevant taxes due on the (Tour) price or fee to the relevant tax authorities. TourTheTropics.com does not act as the merchant of record for any product or service made available on the Platform.
